Conditions of
entry

For the comfort, safety, security and enjoyment of all visitors, attendees, ticketholders, patrons, staff and event participants (Customers), the following conditions of entry (Conditions of Entry) apply in relation to all customers’ use of and/or entry into GMHBA Stadium (the Stadium), which is owned by Kardinia Park Stadium Trust (KPST) and any customers who enters the stadium hereby agrees to comply with these conditions of entry.

CONDITIONS OF ENTRY AND OTHER CONDITIONS – AGREEMENT TO COMPLY

By entering the Stadium each Customer acknowledges and agrees to be bound by these Conditions and that the Customer has had sufficient opportunity to read and understand these Conditions.

These Conditions of Entry are to be read in conjunction with conditions of entry that may apply to:

  1. an event held at the Stadium (Event Conditions);
  2. a sporting event, as required by the applicable governing sports body (Sports Event Conditions), the provisions of the Major Events Act 2009 (Vic) and any applicable Commonwealth or Victorian laws regulating major sporting and other cultural events (Event Laws) and/or
  3. the ticketing agent’s terms and conditions of ticket sale (Ticket Conditions and collectively with Event Conditions, Sports Event Conditions, Event Laws and these Conditions of Entry, the Conditions). Please read the other Conditions for more information. These additional Conditions are generally available on the websites of the relevant sport’s governing bodies’ or event owners’ websites (for example, the official AFL, ICC or Cricket Australia websites) and on the relevant ticket agency’s official website and/or may be printed on tickets and/or posted at entry points to the Stadium.

Customers who do not comply with the Conditions will not be permitted entry into the Stadium, including for any event held at the Stadium (an Event). Customers who have been admitted into the Stadium but subsequently fail to comply with these Conditions may be removed from the Stadium without refund of any entry/ticket fee(s) or any other recourse.

KPST reserves the right to:

  1. manage Customer, vehicular and bag access to the Stadium through manual and screening equipment/checks; and
  2. refuse entry to the Stadium of any bags, vehicles, or other objects for any reason whatsoever (subject only to applicable laws).
    1. All Customers and their possessions will be subject to screening before entering the Stadium and may be subject to screening upon exit.
    2. Customers must comply with any request for electronic, mechanical and/or personal body, bag or vehicular screening. Customers must not attempt to conceal their identity, either at the point of entry or while inside the Stadium. KPST will respect cultural differences and medical conditions, but reserves the right to refuse entry to, or remove from, the Stadium anyone who covers their face with a scarf, balaclava, mask, helmet, etc.
    3. Customers who refuse to participate in any screening may be denied entry to the Stadium or may be required to leave the Stadium.
    4. Any person having entered the Stadium and found to be in possession of a Prohibited or Restricted Item, shall have such item confiscated and may be removed from the stadium.
    5. KPST reserves the right to screen any bag and/or articles of clothing for Prohibited/Restricted Items.
  1. KPST reserves the right to refuse entry to remove or evict, fine, or ban from the Stadium or any KPST property, without refund or compensation of any kind, any person or Customer, including any person or Customer:
    1. who does not comply with the Conditions or who Stadium management has grounds to reasonably believe is likely to not comply with the Conditions;
    2. who jeopardises or who Stadium management has grounds to reasonably believe is likely to jeopardise the health, safety or security at the Stadium or of the Event;
    3. considered by Stadium staff to be to be disorderly, quarrelsome, threatening or abusive, intoxicated or under the influence of drugs or whose presence at the Stadium is, or could constitute, a source of danger, nuisance or annoyance to other Customers or any other person at the Stadium;
    4. attempting to bring in, or found in possession of, any Prohibited/Restricted Items;
    5. engaging in a Prohibited/Restricted Activity;
    6. failing or refusing to comply with any direction, instruction, request or announcement made by any authorised representative of KPST and/or any representative of any law enforcement agency or other governmental authority;
    7. previously issued with a Court Banning Notice, Code Administrator or KPST Banning Notice that still applies; or
    8. not authorised to be in the Stadium e.g. without a valid entry ticket or accreditation.
  2. Additionally:
    1. Customers under the age of 12 years must be accompanied by a parent or guardian at all times within the Stadium and may be refused entry into the Stadium unless accompanied by a parent or guardian; and
    2. Concession CUSTOMERS must show a valid identification card as proof of eligibility at the ticket box and at the turnstile.

The following is a non-exhaustive list of items that are prohibited by law and/or are not permitted to enter the Stadium (Prohibited/Restricted Items):

  1. illegal substances including controlled, dangerous, or illicit drugs;
  2. flares, fireworks, knives or other weapons (including firearms), laser pointers or lights, explosives and smoke generators or smoke bombs;
  3. alcohol and alcoholic beverages;
  4. glassware, glass bottles, cans, and breakable containers (including any spray or aerosol cans);
  5. missiles of any description;
  6. recreational equipment such as skateboards, skates, rollerblades, scooters, segways or bicycles;
  7. animals and pets (other than guide/assistance dogs);
  8. musical instruments and noise makers, including whistles, hooters, horns, drums and vuvuzelas;
  9. non-accredited or professional photographic equipment (including cameras and tripods) and recording devices for commercial purposes including audio and video equipment;
  10. drones or any similar aircraft or other remote-controlled vehicles;
  11. confetti or shredded paper;
  12. balloons or other inflatable items;
  13. flag poles composed of materials other than plastic or wood or greater than 1.5 metres in length;
  14. signs, banners, flags and/or clothing displaying offensive, political, racial, or unauthorised commercial material;
  15. flags/banners with handles exceeding 1.6 meters;
  16. promotional products;
  17. chairs/stools;
  18. prams, pushers, eskies, coolers, iceboxes, bags and any other large items if they are too large to fit safely under the Customer’s seat without impeding access;
  19. umbrellas must be stored under a seat;
  20. any other item determined by Stadium staff that may cause injury, harm, a public nuisance or which may otherwise compromise the health, safety, security or comfort of other Customers; and
  21. food or beverage products purchased at commercial outlets outside the Stadium other than for personal consumption.

The following is a non-exhaustive list of activities that are prohibited within the Stadium (Prohibited/Restricted Activities) and participation in such activities may result in immediate removal from the Stadium:

  1. carriage (or operation) of any Prohibited/Restricted Items;
  2. smoking anywhere within Stadium (including the use of e-cigarettes, vaping, etc.) and any designated smoke-free areas immediately outside the Stadium;
  3. opening umbrellas while inside the Stadium;
  4. displaying commercial or offensive signage or conducting any promotional or commercial activities;
  5. soliciting and customer surveying not authorised by KPST;
  6. taking alcoholic beverages into or from the Stadium;
  7. throwing objects of any description;
  8. striking or igniting flares, fireworks, explosives and or smoke bombs;
  9. harassing any other person in or around the Stadium;
  10. using homophobic, discriminatory, racist, or otherwise offensive language or conduct;
  11. concealing identity with a scarf, balaclava, mask or other item unless for a religious, medical or other justifiable reason;
  12. storage of equipment or standing/sitting in aisles or walkways;
  13. bringing food or beverage products purchased at commercial outlets into the Stadium other than for personal consumption – 1 order per person;
  14. unless otherwise expressly authorised by KPST, entering the field of play. Prosecutions may be pursued for unauthorised access to either the Stadium or field of play; and
  15. failing or refusing to comply with any direction, instruction, request or announcement made by any authorised representative of KPST and/or any representative of any law enforcement agency or other governmental authority.

All Customers entering the Stadium are advised that:

  1. they are entering a licensed premise;
  2. it is an offence for minors to purchase and consume liquor or other alcohol;
  3. it is an offence to purchase liquor or other alcohol for (or supply liquor or other alcohol to) minors;
  4. persons supplying liquor or other alcohol to minors will be reported to the relevant law enforcement agencies (including the police); and
  5. penalties and fines may apply under any relevant or applicable laws (including licensing, criminal and liquor laws).

Attending sporting events, concerts and cultural or other entertainment events may be dangerous and any activities conducted at those events and the venues that host those events may be dangerous. Risks include injury, collision with fixed or moving objects, falling or tripping, exposure to adverse weather, loss of or damage to personal property or acts of violence committed by other Customers. Customers are admitted to the Stadium at their own risk. Moreover, CUSTOMERS bring personal items into the Stadium at their own risk.  Neither KPST nor any Event promoter or Stadium Hirer will be held responsible for any damages to, loss or theft of a customer’s personal property nor for any other loss, damage or injury suffered by any customer, whether in contract, tort or statutory liability to the full extent permitted by law and Customers assume all risk of any damage or loss (including property damage, personal injury, economic and consequential loss) however it arises at or around the Stadium.

By entering the Stadium or being present on Stadium grounds, Customers consent to their image, likeness or voice being captured and used by KPST or any third party authorised by KPST in any form or medium and on any platform or in any media, as part of any recording of the event or for any other purposes determined by KPST, including as part of any broadcast or recording of an Event and for any other commercial or non-commercial purposes (including for security and safety purposes or in advertising and promotional materials).

Moreover, in order to enhance security, to protect the safety of Customers at the Stadium and in order to ensure compliance with the Conditions, KPST (and its staff and/or agents) may operate camera, surveillance or other monitoring equipment within and surrounding the Stadium (including security cameras). By entering the Stadium, Customers consent to information about them (including images, voice, data and photographs) being recorded by such equipment and to KPST disclosing this information to any third party (including law enforcement agencies, persons involved in relevant legal or disciplinary actions and the promoters or governing bodies of the organisations holding or owning Events at the Stadium) to the extent that KPST deems such disclosure to be necessary or appropriate so as to protect its or those third parties’ lawful interests, the public interest or the safety of persons or property at the Stadium.

If a Customer breaches or failed to fully comply with any of these Conditions, they may be:

  • denied access to, or evicted or removed from, the Stadium;
  • banned from attending future Events at the discretion of KPST;
  • fined by the Stadium; and/or
  • asked for identification by KPST (including its authorised contractors, agents or employees), law enforcement agencies, Stadium management or security staff.

Information collected from or on Customers who breach the Conditions may be shared between Stadium management, security staff, Stadium hirers and promoters and/or law enforcement agencies. This information may be used to prosecute or support the implementation of a ban on the Customer, or for other law enforcement purposes.

If a Customer breaches or failed to fully comply with any of these Conditions, they may be:

  1. denied access to, or evicted or removed from, the Stadium;
  2. banned from attending future Events at the discretion of KPST;
  3. fined by the Stadium; and/or
  4. asked for identification by KPST (including its authorised contractors, agents or employees), law enforcement agencies, Stadium management or security staff.

Information collected from or on Customers who breach the Conditions may be shared between Stadium management, security staff, Stadium hirers and promoters and/or law enforcement agencies. This information may be used to prosecute or support the implementation of a ban on the Customer, or for other law enforcement purposes.

Customers hereby consent for their name, address, date of birth, voice and image/photograph to be provided by KPST to any law enforcement agency (including State or Federal Police) or security staff, including in circumstances where they are evicted from or arrested within the Stadium and for any law enforcement agency (including State or Federal Police) to disclose to KPST the nature and result of any action or criminal proceeding initiated by any law enforcement agency or because of their eviction from or arrest within the Stadium or conduct while within the Stadium.

All Customers entering the Stadium are advised, in accordance with applicable privacy laws, that any law enforcement agency (including State or Federal Police) may provide KPST with the name, address, date of birth, voice, image and photograph of any person detained or arrested by that or any other law enforcement agency at the Stadium and the nature of any action or criminal proceeding initiated by any law enforcement agency (including State or Federal Police) as a consequence so that KPST can consider implementing, and if deemed necessary by KPST implement, a ban on the Customers from attending future Events at the Stadium.

Customers have certain rights to access personal information held by KPST and can request access by contacting KPST’s Privacy Officer by email to enquiries@kardiniapark.vic.gov.au or by telephone on 03 5224 9111.

Customers acknowledge and agree that KPST and its staff and agents may exercise any rights granted under the Major Events Act 2009 (Vic) or other federal, state or local legislation, ordinances or regulations relating to the Stadium or any Events at the Stadium.

TICKETS

  1. Customers must occupy the seat specified on their ticket. Customers will only be permitted to leave their seat during the course of an Event to purchase food, beverage or merchandise item, attend public amenities or exit the Stadium.
  2. Customers must retain their tickets in their possession at all times whilst within the Stadium and tickets must be produced upon request.
  3. Any tickets that are damaged, defaced or have been purchased from an unauthorised agent will not permit the holder to be admitted to the Stadium.
  4. Tickets to events at the Stadium must not be used in relation to any unauthorised promotion or competition. Unauthorised promotional or commercial activities within the Stadium, including in relation to an event or function or otherwise, are not permitted.
  5. Unless otherwise expressly permitted by the Ticket Conditions, Customers must not resell or transfer, or attempt to resell or transfer, a ticket to any Event at the Stadium at a premium or package a ticket to any event at the Stadium with other goods and services.
  6. No ticket refund will be paid to Customers ejected from the Stadium. If removed, it is an offence to re-enter or attempt to re-enter the venue for a period of 24 hours.
  7. KPST strongly recommends that all Customers comply with any specified entry time and entry point to an Event as indicated on the Event ticket.

  6. No ticket refund will be paid to Customers ejected from the Stadium. If removed, it is an offence to re-enter or attempt to re-enter the venue for a period of 24 hours.
  7. KPST strongly recommends that all Customers comply with any specified entry time and entry point to an Event as indicated on the Event ticket.

Tickets will not be refunded or exchanged except in accordance with the Ticket Conditions and the “Code of Practice for the Ticketing of Live Entertainment in Australia” (the Code), available at www.liveperformance.com.au.

Pass outs will not be issued to Customers, except at the sole discretion of KPST. Should pass-outs be granted, Customers wishing to re-enter the Stadium must present both the pass-out and a valid ticket to regain entry into the Stadium. Customers will be subject to searches/security screening upon Stadium re-entry.

KPST reserves the right to update, modify or change these Conditions of Entry from time to time. Any changes will be posted and available at www.kardiniapark.com.au and at entry points to the Stadium.
